Incapacitation pay is not line-of-duty care
LOD gets the injury treated. Incapacitation pay is the paycheck when that injury stops military duty or civilian wages. It is a request. It does not start because TRICARE paid a bill.
01
Get the line-of-duty determination first
An in-LOD finding is the prerequisite for incapacitation pay. The medical visit and the pay are two decisions. Family members are not on this pay.
02
Name which of the two pay rules fits
Unable to perform military duties: pay and allowances of the matching active-duty grade, on request. Able to perform military duties but you lost civilian wages: a portion of that pay, and you have to show the lost income. Either way, civilian earned income reduces what you receive.
03
Ask the component. There is no VA.gov button.
Army Guard and Army Reserve process this under AR 135-381. Other Reserve components use the same DoDI through their personnel office. A request is generally for no more than six months unless the approval authority extends it.
